Nutzungsbedingungen für den Service vLab auf https://*.vlab.fm.fhws.de:

§ 1 Geltungsbereich

(1) Die nachfolgenden Bedingungen gelten für die Nutzung des vLab auf der Domain https://*.vlab.fm.fhws.de - im folgenden "vLab" genannt. Für die Nutzung des vLab ist wichtig, dass Sie als Nutzer/Nutzerin die nachfolgenden Regeln bzw. Bedingungen akzeptieren. Die Benutzung des vLab ist kostenlos.

(2) Mit dem erstmaligem Login sind Sie mit den Nutzungsbedingungen des vLab einverstanden.

(3) Durch das Benutzen des vLab kommt kein Vertrag zwischen den Nutzern/Nutzerinnen und dem Betrieber zustande.

 § 2 Pflichten als Nutzer/ Nutzerinnen

 (1) Einer Ihrer Pflichten als Nutzer/Nutzerin ist es, dass Sie das vLab nicht mißbräuchlich nutzen.

Folgende Punkte sind Ihnen nicht genehmigt:

1. Inhalte zu veröffentlichen, die deren Veröffentlichung einen Straftatbestand oder eine Ordnungswidrigkeit erfüllt,
2. Versendung von Spam über das vLab,
3. Verwendung von gesetzlich durch Urheber- und Markenrecht geschützte Inhalte ohne rechtmäßige Berechtigung,
4. Handlungen, die wettbewerbswidrig sind,
5. eigene kommerzielle Nutzung und
6. Tätigkeiten insbesondere das erstellen von Schad-Software die zur Störung des Betriebs des vLab führen.

Ihre Pflicht als Nutzer/Nutzerin ist es, auf § 2 Abs. 1 Nr. 1-5 dieser Nutzungsbedingung, vor  der Veröffentlichung von Daten oder Informationen zu beachten und zu überprüfen, ob Sie sich an diese Punkte gehalten haben.

(2)   Sollten Sie gegen § 2 Abs. 1 Nr. 1-5 dieser Nutzungsbedingung verstoßen, behalten wir uns das Recht vor, gegen Sie folgende Schritte vorzunehmen:

1. Ihre eingestellten Daten zu löschen,
2. Verbot weiterhin das vLab zu nutzen und
3. Sperrung des Zugangs als Nutzer/Nutzerin.

(3)  Haben Sie als Nutzer/ Nutzerin nicht die Forenregeln beachtet und sind hierdurch mögliche Rechtsverstöße entstanden, die durch Ihre Inhalte im vLab entstanden sind (Pflichtverletzung), verpflichten Sie sich als Nutzer/Nutzerin, uns von jeglichen Ansprüchen, auch den Schadenersatzansprüchen, freizustellen und diesen die Kosten zu ersetzen.

Zudem ist der Nutzer/die Nutzerin verpflichtet uns, bei Schadenersatzansprüchen hinsichtlich der Abwehr des durch ihn entstandenen Rechtsverstoßes (Pflichtverletzung s.o.), zu unterstützen und die Kosten einer angemessenen Rechtsverteidigung für uns zu tragen.

 § 3 Haftungsbeschränkung

(1) Wir übernehmen keinerlei Gewähr für die im vLab veröffentlichten und bereitgestellten Informationen und Daten. Wir sind auch nicht verpflichtet, permanent die übermittelten und gespeicherten Daten der Nutzer/Nutzerinnen zu überwachen oder nach den Umständen zu erforschen, ob sie auf einen rechtswidrigen Inhalt hinweisen. Wir haften grundsätzlich nur im Falle einer vorsätzlichen oder grob fahrlässigen Pflichtverletzung.

(2) Es ist wird nicht für einen ständigen unterbrechungsfreien Abruf der Webseite bzw. Funktion des vLab garantiert. Einer Haftung diesbezüglich wird hiermit ausdrücklich widersprochen. Auch bei großer Sorgfalt können Ausfallzeiten leider nicht ausgeschlossen werden.

 § 4 Änderungsvorbehalt

Wir haben jederzeit das Recht die Nutzungsbedingungen zu ändern. Die Änderung wird dann per Nachricht an die Nutzer/Nutzerinnen mitgeteilt.

§ 1 Scope of application

(1) The following terms and conditions apply to the use of the vLab on the domain https://*.vlab.fm.fhws.de - hereinafter referred to as "vLab". It is important for the use of the vLab that you as a user accept the following rules and conditions. The use of the vLab is free of charge.

(2) By logging in for the first time, you agree to the vLab Terms of Use.

(3) Use of the vLab does not constitute a contract between the user and the operator.

 § 2 Duties as users

 (1) One of your duties as a user is to ensure that you do not misuse the vLab.

The following points are not authorized for you:

1. to publish content whose publication would constitute a criminal offence or an administrative offence
2. sending spam via the vLab,
3. use of content protected by copyright and trademark law without legal authorization,
4. acts which are anti-competitive,
5. own commercial use and
6. activities, in particular the creation of malicious software that leads to disruption of the operation of the vLab.

It is your duty as a user to observe § 2 para. 1 no. 1-5 of these Terms of Use before publishing data or information and to check whether you have complied with these points.

(2) Should you violate § 2 para. 1 no. 1-5 of these Terms of Use, we reserve the right to take the following steps against you:

1. to delete your posted data,
2. prohibition to continue using the vLab; and
3. blocking of access as a user.

(3) If you, as a user, have not observed the forum rules and possible legal infringements have arisen as a result of this, which have been caused by your content in the vLab (breach of duty), you undertake as a user to indemnify us from all claims, including claims for damages, and to reimburse us for the costs.

In addition, the user is obligated to support us in the event of claims for damages with regard to the defense of the legal violation (breach of duty, see above) and to bear the costs of an appropriate legal defense for us.

§ 3 Limitation of liability

(1) We assume no liability for the information and data published and provided in the vLab. We are also not obliged to permanently monitor the transmitted and stored data of the users or to investigate the circumstances to determine whether they indicate illegal content. As a matter of principle, we shall only be liable in the event of an intentional or grossly negligent breach of duty.

(2) No guarantee is given for continuous uninterrupted access to the vLab website or its functions. Any liability in this respect is hereby expressly contradicted. Unfortunately, downtimes cannot be excluded even with great care.

 § 4 Subject to change

We have the right to change the terms of use at any time. The change will then be communicated to the users by message.
